How Does Divorce Work in California? 

Like most states, California is a no-fault state when it comes to filing for divorce. This means that you do not need to prove that your spouse did something unlawful or wrong to file for divorce. However, there are certain steps that you will need to follow when seeking a divorce in California. 

Below is a general overview of the divorce process in California: 

  • Filing a Summons and Petition for Dissolution of Marriage: The first step in the divorce process is filing a summons (FL – 110) and petition for dissolution of marriage (FL – 100), as well as certain other forms, with the local court. You must also pay a filing fee. Once the court accepts your paperwork, it will assign a case number. This officially opens your divorce case. 
  • Serving the Divorce Petition on Your Spouse: The next step in the divorce process is serving the divorce petition on your spouse, known as the “respondent.” Most often, the papers must be “personally served,” meaning an adult other than you must physically hand the summons and petition to your spouse. You must then submit proof of service to the court. 
  • Responding to the Petition: Once the respondent has been served the divorce papers, they have a set amount of time (typically 30 days, with personal service) to respond. This is the respondent’s notice to the court that they intend to participate in the divorce process. If they do not respond by the applicable deadline, they may face certain procedural consequences.

What happens after this depends on the specific details of your situation. If you and your spouse share any children, you may next request temporary child custody. If your spouse has requested temporary child custody, you may challenge this and/or request visitation time. You may also file a petition for temporary alimony/spousal support, as well as child support. 

In many cases, a divorce hearing will be held where both sides can present evidence. While your presence may not always be mandatory, it is generally a good idea to attend the hearing. Our attorneys can advise you and prepare you for your divorce hearing (if applicable). 

You and your spouse will also likely be required to disclose all community and separate property, as well as various assets, income, expenses, and debts that fall under either category. The court uses this information to rule on the division of assets according to the state’s community property rules. You (and your legal counsel) may also request information from your spouse (and vice versa) during the discovery process. In some cases, the use of expert witnesses may be appropriate; in others, you may be able to reach agreements on various issues involved in the divorce outside of the court.
